However, <\/span><span style=\"font-weight: 400;\">eligibility for the Program <\/span><span style=\"font-weight: 400;\">is not automatic. To be admitted, <\/span><span style=\"font-weight: 400;\">the <\/span><span style=\"font-weight: 400;\">application <\/span><span style=\"font-weight: 400;\">must meet the requirements established by Brazilian Patent and Trademark Office (BPTO)\u2019s Ordinance No. 79\/2022 and be the subject of a request for participation in the Program.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Understanding these requirements is essential for inventors, companies, and research institutions to assess, from the outset, the feasibility of submitting such a request.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Who <\/b><b>m<\/b><b>ay <\/b><b>a<\/b><b>pply?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Green Patents Program covers both Invention Patents (PI) and Utility Models (MU). In addition, the patent application must have already been published in the Industrial Property Gazette (RPI) or be accompanied by a request for early publication. It is also necessary that the request for <\/span><span style=\"font-weight: 400;\">substantive <\/span><span style=\"font-weight: 400;\">examination has already been filed and that the examination has not yet <\/span><span style=\"font-weight: 400;\">commenced <\/span><span style=\"font-weight: 400;\">before the <\/span><span style=\"font-weight: 400;\">BPTO.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The applicable regulation also establishes a limit of fifteen claims, of which up to three may be independent, and requires that the technology be classified under one of the categories covered by the International Patent Classification (IPC) Green Inventory, which includes fields such as alternative energy, transportation, energy conservation, waste management, and sustainable agriculture. Where the applicant is domiciled abroad, <\/span><span style=\"font-weight: 400;\">a Brazilian representative must also be appointed<\/span><span style=\"font-weight: 400;\"> to act on its behalf before the BPTO.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>How <\/b><b>d<\/b><b>oes the <\/b><b>p<\/b><b>rocedure <\/b><b>w<\/b><b>ork?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Applications for admission are<\/span><span style=\"font-weight: 400;\"> submitted electronically through the BPTO&#8217;s e-Patentes system.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the patent application has been filed and published, and once the request for substantive examination has been submitted,<\/span><span style=\"font-weight: 400;\"> the applicant may request participation in the Green Patents Program by completing the appropriate form and paying the applicable official fee. If the request is accepted, the application will proceed under a priority examination until the conclusion of the <\/span><span style=\"font-weight: 400;\">substantive <\/span><span style=\"font-weight: 400;\">examination.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>What <\/b><b>a<\/b><b>re the <\/b><b>b<\/b><b>enefits?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The main benefit of the Program is <\/span><span style=\"font-weight: 400;\">the shorter time<\/span><span style=\"font-weight: 400;\"> required to obtain a decision from the BPTO.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the <\/span><span style=\"font-weight: 400;\">benefits extend beyond <\/span><span style=\"font-weight: 400;\">administrative efficiency. A patent granted more quickly may strengthen a company&#8217;s intellectual property strategy, <\/span><span style=\"font-weight: 400;\">provide greater legal certainty<\/span><span style=\"font-weight: 400;\"> for investments, facilitate licensing and technology transfer negotiations, and <\/span><span style=\"font-weight: 400;\">enhance<\/span><span style=\"font-weight: 400;\"> the value of the organization&#8217;s intangible assets.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For companies operating in innovation-intensive sectors, obtaining a patent <\/span><span style=\"font-weight: 400;\">more quickly <\/span><span style=\"font-weight: 400;\">may also represent a significant competitive advantage, particularly in <\/span><span style=\"font-weight: 400;\">industries <\/span><span style=\"font-weight: 400;\">where <\/span><span style=\"font-weight: 400;\">time to market<\/span><span style=\"font-weight: 400;\"> is a strategic consideration.
